Extrajudicial adverse possession: regularization directly at the registry office.
Since the 2015 Code of Civil Procedure, adverse possession can be processed directly at the Land Registry Office, with a notarial deed, site plan, and descriptive report, when there is no dispute. In many cases, the extrajudicial procedure is faster than a lawsuit. We analyze the documentation and indicate the most appropriate path for each situation.
Why regularize your property?
A property with proper registration can be sold, financed, used as collateral, and divided safely, in addition to increasing in market value. Lack of registration exposes the owner to disputes, hinders inheritance, and prevents access to credit.
Frequently Asked Questions
How long is possession required to claim adverse possession?
It depends on the type of adverse possession. The time periods stipulated by law generally vary from 2 to 15 years, depending on the type of adverse possession, the size and use of the property, and the manner of possession.
I bought it with a private contract (a "drawer contract" in Portuguese). Can I get the deed?
In many cases, yes. Compulsory adjudication, whether judicial or extrajudicial, allows registration when the seller does not grant the final deed, provided that payment is proven.
What documents are needed?
Generally, personal documents, proof of ownership (bills, property tax bills, contracts), property certificates and, depending on the case, a floor plan and descriptive report. The exact list is defined after analyzing the case.
Can I legalize a property I received through inheritance?
Yes. Regularization can be done through probate, either through the courts or at a notary's office, or by other means, depending on the situation of the property and the heirs.
